Patna, Apr 25 (PTI) Senior BJP leader Syed Shahnawaz Hussain today questioned the delay in arresting Suresh Kalmadi and demanded action against Delhi Chief Minister Sheila Dikshit and others for their alleged involvement in the CWG scam. "The people of the country would like to know the reason behind the inordinate delay in the action taken against the former CWG Organising Committee Chairman Suresh Kalmadi," Hussain told reporters here. "Immediate action mush also be taken against Delhi chief minister and others for their involvement in CWG irregularities and other related construction works," he said. Prime Minister Manmohan Singh formed the Shunglu committee to submit a report about the irregularities in in organising the sporting event. After submission of the committee report, the CEO of Prasar Bharati was shown the door, he said. "But no action has been taken against others whose names have figured in the report. The country demands an answer," he said.

Ending months of speculation, the chief organiser of the 2010 Commonwealth Games (CWG) in Delhi, Suresh Kalmadi, was on Monday arrested following an investigation into allegations of corruption. Kalmadi was arrested by the Central Bureau of Investigation over alleged irregularities in the conduct of Queen's Baton Relay (QBR) held in London in 2009.Stung by the CBI's supplementary chargesheet in the 2G scam that names party chief M Karunanidhi's daughter Kanimozhi as a co-conspirator, the DMK has reacted sharply. The party has convened a high-level executive committee meeting on Wednesday, to decide on its 'future course of action.'

Two officials of the 2010 Commonwealth Games Organising Committee (OC) —Sujit Lal and ASV Prasad — were also arrested along with Kalmadi.

Kalmadi was removed from his post as the head of the Organising Committee of CWG in January.

A spokesman for CBI said Kalmadi was arrested "for conspiracy to cause favour to a company in Switzerland while procuring timers and scoring equipment for the games". Kalmadi is expected to appear in court on Tuesday.

In a statement, the DMK said that Ms Kanimozhi's questioning by the CBI, and that of Mr Karunanidhi's wife, Dayalu Ammal, was heavily publicised. The statement said that the supplementary chargesheet filed by the CBI was even more publicised.

The party also contended that inspite of Kalaignar TV's proof given for the Rs. 200-crore loan and its repayment, Kanimozhi and the channel's Managing Editor Sharad Kumar were charged by the CBI.

Kanimozhi, who is also accused of accepting a bribe, has been asked to appear in the Delhi court trying the 2G case on May 6. (Read: 2G chargesheet: Kanimozhi accused of conspiracy. In 2008, A Raja, a DMK leader, was the Telecom Minister when he sold spectrum and mobile network licences for a jaw-dropping low price to companies that were largely ineligible for either, according to government guidelines.

One of those companies - Swan Telecom - allegedly sent Mr Raja a Rs. 214-crore kickback that was routed through a maze of companies but rested finally with a TV channel in Chennai that is owned mainly by Kanimozhi and Dayalu Ammal. Together, they have 80% stake in the company. Sharad Kumar, the Managing Director of Kalaignar TV, owns the balance and has also been accused of conspiring with Mr Raja. Like Kanimozhi, Mr Kumar was interrogated earlier this year by the CBI. Both of them said that the Rs. 214-crore payment was for a sale in equity that unraveled; they claim they returned the entire amount with 30 crores in interest.

The CBI in its supplemetary chargesheet, filed today, states, "The refund of the entire amount has occurred after the registration of the CBI case. Infact the date when the refund of the amount started, December 23, 2010, coincides with the date when accused A Raja was asked to join investigation at the CBI office on December 24 and December 25. A major chunk of funds was refunded after December 25, 2010. Investigation has established that pursuant to the criminal conspiracy, accused Raja, Sharad Kumar, Kanimozhi, stakeholders of Kalaignar TV, accepted and received an illegal gratification of Rs. 200 crore in Kalaignar TV from accused Shahid Balwa and Vinod Goenka from the accounts of DB Group Companies in 2008-09, as a reward in lieu of the undue favours shown by Raja." Mr Raja is in jail. So are Shahid Balwa and Vinod Goenka, both partners in DB Realty and Swan Telecom, which was later sold to Etisalat and is now called Etisalat DB.

Also chargesheeted today for abetment to bribery, are top executives of the companies that Mr Balwa allegedly used to route his kickback to Mr Raja. They include Karim Morani of Cineyug Films; Rajiv Aggarwal of Kusegaon Realty and Mr Balwa's brother, Asif, whose involved with the same company.

The CBI says on different fronts, it's clear that Kanimozhi was an active participant in the running of Kalaignar TV and that she was one of Mr Raja's partners in crime. She lobbied with the Ministry of Information and Broadcasting permits for Kalaignar. In Delhi, she campaigned privately for Mr Raja to return for a second term as Telecom Minister in 2008, after the UPA alliance won the general elections.   

Her phone conversations with corporate lobbyist Niira Radia, who is now a witness in the 2G trial, have done much damage for the young DMK leader. Ms Radia's phones were tapped as part of an income tax investigation and it is in her different conversations that the first picture of the 2G scam emerged.

As recently as Friday, the CBI was insistent that Dayalu Ammal would be listed in the new chargesheet. However, weekend reports suggested that her sons - MK Alagiri and MK Stalin who are both senior DMK leaders - were furious about attempts to link her to the scam. Within the CBI, too, there was allegedly a divide over whether to involve her. Some investigators felt that given the fact that she is in her 80s, and does not understand English, it would be hard to prove that Dayalu Ammal knew of her channel's financial transactions.


The CBI on Monday filed its second charge sheet in the 2G spectrum case naming Tamil Nadu Chief Minister M. Karunanidhi's daughter and MP Kanimozhi and four others as accused.However, the CBI has not named Mr. Karunanidhi's wife Dayalu Ammal, whose name had figured in the 2G probe, as the accused in the supplementary charge sheet filed before Special judge O.P. Saini.

Tamil Nadu Chief Minister M. Karunanidhi on Monday evaded questions about the Dravida Munnetra Kazhagam (DMK) planning to quit the Union cabinet after his family members were named by CBI in the 2G spectrum allocation scam.
Speaking to reporters here, he said he was not aware of any of his family member being possibly named by CBI in the second charge sheet in the scam.
"I don't know," he said to a question on reports that his daughter Kanimozhi, MP, and wife Dayalu could be named.
The 87-year-old leader went on to add that the names will be revealed as the media would report it after the charge sheet was filed in a Delhi court.
Responding to reports about DMK's possible exit from the UPA cabinet in this connection, he shot back "Is that your desire?"
"Being a woman, you should not talk as if you are heartless," he said when women reporters persisted in asking him about 2G and his equations with the UPA.
Taking a dig at the media, he said they would report "the slightest of dirt" on DMK, but said he would still continue to read the newspapers.
Former Telecom Minister A. Raja had been arrested in connection with the alleged scam, and the investigating agency had questioned Ms. Dayalu and Ms. Kanimozhi in Chennai recently.


Others who have been charge sheeted along with Ms. Kanimozhi are Kalaignar TV Managing Director Sharad Kumar, Swan Telecom promoter Shahid Usman Balwa's cousin Asif Balwa, Rajeev Agarwal — Directors of Kusegaon Fruits and Vegetables Pvt Ltd, and Karim Murani of Cineyug Films (Pvt) Ltd.
The special court summoned Kanimozhi, Sharad Kumar and Karim Morani to appear before it on May 6 as accused in 2G spectrum case saying "there is enough incriminating material on record" to proceed against them.
Ms. Kanimozhi has been charged with section 7 and 11 of the Prevention of Corruption Act. The sections deal with acceptance of alleged gratification.
Ms. Kanimozhi, Mr. Sharad Kumar and Mr. Murani have not been arrested by the CBI but Mr. Asif Balwa and Mr. Agarwal are in judicial custody.
The charge sheet said the investigation into the case disclosed that money had travelled from DB Realty to Kalaignar TV.
Ms. Kanimozhi, Ms. Dayalu Ammal and Mr. Sharad Kumar have 20, 60 and 20 per cent shares in the channel respectively.
The CBI told the court that Rs 200 crore connected with the 2G spectrum scam had travelled from a partnership firm of Swan Telecom Promoter Shahid Usman Balwa to Kalaignar TV Pvt. Ltd.
The agency, which in the first charge sheet had said the money travelled through a "circuitous route" through Kusegaon Fruits and Vegetables Pvt Ltd, a DB group company and Cineyug Films Pvt Ltd, has maintained the position in the second charge sheet.
"Investigations have revealed that in furtherance of the conspiracy, Dynamix Realty, a partnership firm of DB Realty Ltd and other DB group companies, paid Rs 200 crore to Kalaignar TV Pvt. Ltd during December 2008 to August 2009, following a circuitous route through Kusegaon Fruits and Vegetables Pvt. Ltd and Cineyug Films Pvt Ltd (DB group holds 49 per cent equity in it)," CBI had said in its first charge sheet filed on April 2.



Suresh Kalmadi, sacked CWG organizing commmittee chief, on Monday appeared to be in for more trouble as Congress, having suspended him, did not rule out further disciplinary action in the wake of his arrest by CBI in connection with alleged graft in the Commonwealth Games.

"Let there be no ambiguity... at appropriate time, appropriate demonstrable and visible action will be taken," party spokesperson Manish Tewari told reporters at the AICC briefing responding to questions on whether Mr. Kalmadi's arrest was an embarrassment for the party and whether he would be removed as an MP after being seen as a symbol of corruption by the middle class.

Mr. Kalmadi was earlier removed from the post of Congress Parliamentary Party Secretary after controversies hit the Games. After the Games, he was sacked as chief of the Orgnaizing Committee by the government.

The Congress MP from Pune was arrested on Monday on allegations of conspiracy to favour a private firm in Switzerland by awarding contract at inflated cost of Rs 141 crore in the CWG.

Seeking to take a high moral ground on the issue of corruption, Mr. Tewari said that Congress party has acted whenever there a "whiff of corruption" and it has been a tradition in his party.

He said it was Congress-led UPA government that had set up the Shunglu committee and party President Sonia Gandhi had made it clear during a Congress Parliamentary Party meeting last year that investigations into allegations of corruption and irregularities would be carried out once the Games are over and guilty will not be spared.

The Opposition BJP and the CPI(M) on Monday said the arrest of Suresh Kalmadi, the sacked CWG organising Committee chief, was "belated" and only the "tip of the iceberg."
The two opposition parties wanted investigating agencies to take stringent action against others involved in the Commonwealth Games scam.
"This (arrest) is only the tip of the iceberg, " BJP president Nitin Gadkari told reporters at Maharashtra BJP office in Mumbai.
"(Mr.) Kalmadi is not the only one. Others have not been arrested. CBI should take stringent action against those involved in the Commonwealth Games scam," he said.
Echoing Mr. Gadkari's sentiments, CPI(M) leader Brinda Karat said the "belated action" of Mr. Kalmadi's arrest hardly brought any confidence and that it was "only the tip of an iceberg."
Ms. Karat, who is in Kolkata, said the Shunglu Committee and the Comptroller and Auditor General (CAG) had in their reports "implicated the Delhi governments and some departments under central ministers."
"Therefore, the huge CWG scam is yet another piece of evidence about the corruption which has proliferated under the Manmohan Singh government. The fact that the action is so belated hardly brings any confidence," she said.
The action required now should really be in the aspects which have been pointed out by the Shunglu panel and the CAG, Karat said, adding that investigations should not be limited to "just in one case, when thousands of crore of rupees is involved. Action should be taken against all those named in the Shunglu report and questions raised by the CAG."
The CPI(M) Politburo came out with a statement calling Mr. Kalmadi's arrest "belated" and "much delayed" and demanded that the CBI take steps to lodge cases and prosecute others responsible for the irregularities.
Maintaining that the arrest of the Congress leader "for corruption" associated with the games was welcome though it was "much delayed", the party said the CBI should forthwith register cases and prosecute "those who were responsible for the expropriation of public funds."
"Apart from the instances of corruption indulged in by the organising committee of the CWG, there is large scale misuse of funds for the games by other agencies and authorities in the Delhi Government and the Central Government. Some of these have been enquired into by the Shunglu Committee," it added.
BJP's Pune unit chief and MLA Girish Bapat demanded resignation of Mr. Kalmadi who is an MP from the city.
"CBI would not have arrested (Mr.) Kalmadi unless it had certain proof against him in the CWG scam", he added.
Shiv Sena MLC and spokesperson Neelam Gorhe said the "big fish" behind Mr. Kalmadi should also be traced and booked. Pune's prestige had taken a beating with the arrest of Mr. Kalmadi who represents the city in the Parliament, she added.

Suresh Kalmadi (born May 1, 1944) is an Indian politician and senior sports administrator. He was a member of the Indian National Congress political party.He got suspended from Indian National Congress as he was convicted in CWG Scam. Suresh Kalmadi studied at St. Vincent's High SchoolPune in the state of Maharashtra in South West India; and then at Fergusson College, Pune. In 1960, he joined the National Defence Academy, Pune, and in 1964, he joined the Air Force Flying Colleges in Jodhpur and Allahabad. He served the Indian Air Force between 1964–1972 and was a recipient of eight medals in his career[3] After a premature discharge from the Air Force, Kalmadi ran a small fast food shop in Pune and was spotted by Sanjay Gandhi during one of his trips there and was one of the young people at that time that he convinced to join politics with the Congress Party. Kalmadi has served effectively in various capacities with the Congress since and is now one of the wealthiest businessman as well in Pune even from his known sources of income.

He was the president of the Maharashtra Pradesh Youth Congress from 1978-1980. He was a member of the Rajya Sabha for three terms from 1982 to 1995, and again in 1998. He was also elected to the 11th Lok Sabha in 1996, and to the 14th Lok Sabha in 2004. Presently, he is the sitting MP from Pune. During the tenure of P. V. Narasimha Rao as the Prime Minister of India, Suresh Kalmadi served as the Minister of State for Railways from 1995 to 1996.[4]

He was the President of the Indian Olympic Association and Chairman of the Organizing Committee of recently concluded Commonwealth Games held in Delhi from 3 to 14 October 2010. On October 11, 2008, in Pune, Kalmadi was elected president of the Indian Olympics Association for the fourth time.[5]

During the felicitation ceremony that had been arranged to honour the three Indian medalists at the 2008 Summer Olympics, Kalmadi reportedly walked out because he had not been offered a chair next to the Vice-President of India Hamid Ansari.[6] In January 2010, former Indian hockey captain Pargat Singh accused Kalmadi of being part of a 'sports mafia'.[7]

Kalmadi's conduct around the 2010 Commonwealth Games has come under scrutiny, with the Chief Vigilance Commission (India's anti-corruption organisation) asking the Central Bureau of Investigation to probe certain aspects of the games' organization.[8] For this, the opposition demanded Kalmadi's resignation.[9] It has been alleged[by whom?] that illegitimate wealth created through overreporting of games costs has been parked with the Jaypee Group, with the financial involvement of his son Sumeer.[10] However, Kalmadi continues to deny corruption charges.[11]

On April 25, 2011, Kalmadi was arrested by the Central Bureau of Investigation, on several charges relating to irregularities in the awarding of contracts for timing and scoring equipment for the 2010 Commonwealth Games.[12][13]

Former Telecom Minister A. Raja and two corporate heads, who have been chargesheeted in the 2G spectrum allocation scam case, on Saturday complained to a Delhi court that documents supplied to them by the Central Bureau of Investigation were incomplete.


In an application filed before Special CBI Judge O.P. Saini, Mr. Raja, Unitech Wireless (Tamil Nadu) Managing Director Sanjay Chandra and Swan Telecom Promoter Shahid Usman Balwa sought supply of the documents.
On this, the CBI assured the court that the documents would be supplied to the accused by April 30.
"A. Raja, Sanjay Chandra, Shahid Balwa, M/S Unitech Wireless (Tamil Nadu) Pvt Ltd and Swan Telecom Pvt Ltd have filed application seeking supply of deficient documents... Senior public prosecutor submits that deficient documents would be supplied by April 30," the court said.
The court has now fixed April 25 for scrutiny of documents and extended the remand of all the accused till then.
The court had earlier on April 20, dismissed the bail plea of five corporate heads — Mr. Chandra, Group MD of Reliance ADAG Gautam Doshi, co-promoter of Swan Telecom Vinod Goenka and Reliance ADAG's Surender Pipara and Hari Nair who have been named as accused in the charge sheet.
The court had dismissed their bail plea saying they may tamper with evidence and even flee to avoid prosecution in the "highest magnitude" 2G spectrum allocation scam.
The agency, in its first charge sheet, running into about 80,000 pages, had said that Mr. Raja conspired with top bureaucrats and corporate head to cause a loss of Rs. 30,984 crore in the allocation of 2G spectrum.
Besides these corporate leaders and Raja, former Telecom Secretary Siddharth Behura, Mr. Raja's personal secretary R.K. Chandolia and Mr. Balwa have also been named as accused in the charge sheet.
The CBI had also named Swan Telecom, Unitech Wireless (Tamil Nadu) and Reliance Telecom in its first charge sheet in the case.

Kalmadi was alleged to have given contracts at higher rates to AM Films and AM Car and Van Hire Ltd during the Baton Relay. The company was paid 127,712 pounds without any written contract.

A two-member CBI team of additional director V.K. Gupta and the DIG, S.K. Palsania, was sent to London to investigate the owner Ashish Patel, who reportedly provided them all the information and documents with regard to the allegedly overvalued deal.

Kalmadi maintained that the company was recommended by the Indian high commission, which later denied having done so.

Chief minister Sheila Dikshit today refused to react on the arrest of sacked Commonwealth Games Organising Committee chief Suresh Kalmadi by CBI in connection with irregularities in awarding contract during the Commonwealth Games.

The chief minister chose not to respond when asked about Kalmadi's arrest.

Kalmadi was arrested by CBI for allegedly awarding a contract for the Commonwealth Games to a Swiss company at an inflated rate of Rs141 crore in a "pre-meditated" manner.

Immediately after conclusion of the Games last October, Dikshit had said the "suspicion" of corruption in the Commonwealth Games was on the organising committee headed by Kalmadi.

Dikshit had said thatcorruption could have taken place in the activities undertaken by the organising committee to which the Central government had given loans to the tune of Rs1,600 crore.

Later Kalmadi, pointing an accusing finger at Dikshit, had said all those involved in preparation of the event should be summoned by CBI.
