Sixth Pay Commission to apply on pre-2006 retirees also: Central Administrative Tribunal
In a relief to senior citizens, who retired from government service before 2006, the Central Administrative Tribunal (CAT) has directed the Centre to re-fix their pension on the basis of recommendations of the Sixth Central Pay Commission (VI CPC).

The order will provide relief to thousands of such retired government servants whose pension would increase substantially.

A three-judge bench of CAT headed by its ChairmanJustice V K Bali quashed the August 29, 2008 government resolution which amended the recomendations of the sixth pay commission due to which the pre-2006 retirees were getting lower pension than the post 2006 retirees.

The bench passed the orders on a bunch of petitions filed by individuals, their association -- Central Government Pensioners Association -- claiming pension at par with post-2006 retirees on the recommendations of the VI CPC, which took effect from January 1, 2006.

"Respondents (Government) are directed to re-fix the pension of all pre-2006 retirees with effect from January 1, 2006... Let the respondents re-fix the pension and pay the arrears thereof within a period of 3 months from the date of receipt of a copy of this order," the bench, also comprising M L Chauhan and Dr Veena Chhotray, said.

Trinamool Congress (TMC) chief and West Bengal Chief Minister Mamata Banerjee's displeasure over the recent increase in petrol prices and her threat to the Congress-led United Progressive Alliance (UPA) Government that it was the Centre that needed her party's support seems to have forced the Union Government to have a rethink over the hike.
"TMC will not remain in UPA government if prices of petro products are hiked again," Banerjee said today, adding that they do not want to blackmail the UPA government.
Union Finance Minister Pranab Mukherjee, who is also the chief troubleshooter for the Congress party, had met Banerjee on Monday for over an hour to negotiate a financial package for the state in a bid to placate her even as the West Bengal Chief Minister once again threatened to quit the UPA.
"If prices of essential commodities go up then the Trinamool will not stay with the UPA. The Prime Minister has told my MPs that there will be no rollback in petrol prices. It is a coalition. They cannot take decisions unilaterally. If they want other parties in the alliance instead of us then we will move away," said Mamata after the meeting. She stopped after speaking a few lines and walked off.
The meeting between Pranab Mukherjee and Mamata Banerjee was held in Kolkata while members of the Trinamool Congress met Prime Minister Manmohan Singh in New Delhi to discuss the latest hike in petrol prices. But the TMC MPs did not raise the issue of quitting the alliance at their meeting with the Prime Minister.
Mamata is reported to be very upset with the ways the Congress has been treating her party and the demand for a financial package for the state.
She wanted Rs 21,600 crore as a package but the Finance Minister, in charge of the nation's purse strings, said that he cannot allot more than Rs 9,000 crore. But the Prime Minister could increase the amount to placate the Trinamool Chief.
Meanwhile, in New Delhi Union Minister of State for Health and Trinamool MP Sudip Bandopadhyay said that he expressed his party's concern over petrol price hike to the Prime Minister.
"We have expressed our concerns over the price hike of petrol. We have submitted our resolution to the Prime Minister. We will report the details to Mamata Banerjee. The Prime Minister agreed that meeting wih allies should be on a regular basis. We have told the Prime Minister that there is huge lack of coordination between allies in UPA-2. He agreed with our sentiments and said that he shared our views on economic conditions of the country," said Bandopadhyay.
Sources have told CNN-IBN that the Prime Minister explained the economic compulsions for the hike in petrol prices. When TMC MPs told the Prime Minister that they had heard that diesel and LPG prices were also to be hiked, Manmohan Singh told them that it was news to him. He told them that there would be no increase in the prices of kerosene, diesel and LPG.
According to the sources the Prime Minister requested the TMC MPs not to act in haste.
According to sources, the UPA government might be forced to concede a partial rollback on the prices after the threat by the West Bengal chief minister to withdraw support.
The government is likely to cut the central excise duty on petrol products.
Another option, the one that the Congress party favours, is to from a UPA Coordination Committee along the lines of the Left-Coordination Committee that existed during UPA-1.
Option three is that the Centre can slash some taxes on petrol, which could slightly reduce the impact of the latest hike.
But Congress sources point out that 7 per cent of the Centre's tax earning from petrol is passed off to West Bengal anyway and the state earns Rs 15.13 per litre from cess and sales tax. So it is the West Bengal government that could reduce taxes instead of the Centre.

Mamata's party members were involved in a brawl between two local clubs- Sevak Sangha and Players Corner and the police. Eyewitnesses claimed that the members of Sevak Sangha were headed to Babughat for Jagadhhatri idol immersion and they burst banned (high decibel) firecrackers right in front of the Chittaranjan Cancer Research Institute. Apart from fire crackers, a DJ was playing music at high volume. Police asked them to stop music and then insisted that they move fast as the procession was causing huge traffic snarl. People in the procession refused to follow the police orders while flaunting their political connections.

Meanwhile, another group of youth (Players Corner) gathered at the spot. While Sevak Sangha group attacked the police at Bhowanipore police station, the Players Corner asked the cops to act against them. Both clubs claimed that among their patrons were the two brothers of the chief minister. And if eyewitnesses are to be believed, the vandals were dropping the names of "high-profile contacts" while attacking policemen, ransacking vehicles and staging a roadblock.

The attack left at least a dozen cops injured, police refused to take action against the attackers. Not a single arrest was made in the incident that prompted chief minister Mamata Banerjee to rush to the spot to pacify the crowd. Worse still, four persons including two members of Mamata's party detained were released after a few hours.

The procession was managed by Jagannath Sau, a close associate of Baban Banerjee, one of Mamata's brothers. Sau was present at the spot as was Baban Banerjee. The attacks were perpetrated by a local strongman, Kumar Saha and his henchmen. Kumar is very close to Jagannath Sau. When contacted, Kumar denied this allegation. "Neither me nor any of my supporters was there... Go through the television footage and check who was present in the front row of the mob," said Kumar.

Finance minister Pranab Mukherjee today declined to comment if a rollback of the petrol price hike was possible, saying that Prime Minister Manmohan Singh was meeting Trinamool Congress MPs on the issue.

"I am not making any comment, particularly when the PM is meeting representatives of Trinamool Congress. Whatever decision PM will take, will be implemented," Mukherjee told reporters when asked if a rollback was possible.

All Trinamool Congress members of the Lok Sabha and Rajya Sabha are scheduled to meet the Prime Minister on the issue.

The party had earlier threatened to withdraw support to the UPA government for the increase in petrol price while keeping its largest ally Trinamool Congress in the dark.

The delegation of the party, which is the second largest constituent of the UPA after Congress with 18 MPs, indicated that it got no assurance from the Prime Minister on the demands for rollback of Rs1.8 hike in petrol price announced last week.

"We expressed our sentiments to the Prime Minister and gave him a copy of the resolution adopted at the Parliamentary Party meeting held in Kolkata," said Union Minister and Trinamool Congress leader Sudip Bandhopadhyay after the 45-minute meeting with Singh.

He said the delegation had categorically told the Prime Minister that Trinamool was opposed to any decision that would lead to another rise in the prices of diesel, LPG and kerosene, as has been reported in the media.

Singh said he was not aware of any such decision, Bandhopadhyay told reporters.

"Trinamool Congress will not digest easily whenever there is another rise in prices of petrol, diesel and LPG," Bandhopadhyay said.

Asked whether the Prime Minister gave any assurance on rollback of the latest petrol price hike, Bandhopadhyay replied in the negative.

During the meeting, Singh shared the economic condition of the country with the delegation, the Trinamool MP said.

The delegation also complained to the Prime Minister about "huge lack" of coordination between Congress and coalition partners.

"We also told him that there is a huge lack of coordination between coalition partners in the UPA-II. There are opportunities to interact with the Prime Minister during Cabinet meetings but there is lack of coordination among allies of the UPA-II," the Minister of State for Health said.

The Prime Minister "agreed" that it will be improved, Bandhopadhyay said.

He said the deliberations with the Prime Minister would be conveyed to Trinamool Congress chief Mamata Banerjee.


The party, which has 18 MPs in the Lok Sabha, got no assurance on rollback of the hike of Rs 1.80 when its delegation of MPs met Prime Minister Manmohan Singh in Delhi to register their unhappiness.

After the 45-minute meeting, the MPs made it clear that the party would continue to be part of the government as of now despite being strongly opposed to the latest price hike.

"We expressed our sentiments to the Prime Minister and gave him a copy of the resolution adopted at the Parliamentary Party meeting held in Kolkata," said Union Minister and Trinamool Congress leader Sudip Bandhopadhyay after the 45-minute meeting with Singh.

Citing media reports which suggested that there could be hike in prices of LPG, diesel and kerosene this month, the delegation told the Prime Minister that Trinamool was opposed to any such move but Singh said he was not aware of any such thing.
"We categorically said if such a decision is taken again, we have to think again whether what will be our stand and we will not take this very easily... We have succeeded in convincing the people that Trinamool Congress will not digest easily whenever decision of price rise is taken," Bandhopadhyay told reporters.
Asked whether Singh gave any assurance on rollback of the latest petrol price hike, he replied in the negative.
Party chief Mamata Banerjee, who held a meeting with Union Finance Minister Pranab Mukherjee in Kolkata, said her party will not remain in the UPA government if prices of petro products hiked again.

India Prime Minister Manmohan Singhbegan a meeting with the biggest ally in the federal coalition government on Tuesday to heal a rift over a fuel price hike last week seen as crucial to shrink a widening budget deficit.

Mamata Banerjee, whose Trinamool Congress party governs the eastern state of West Bengal, has threatened to pull out of Singh's United Progressive Alliance (UPA) last week unless he reversed a rise in gasoline prices.

There was no official word from the meeting yet, but most expect the allies to broker a compromise which could carry a hefty price tag for an already burdened exchequer.

Banerjee has demanded a 190 billion rupee ($3.9 billion) package for her heavily indebted state, according to Indian media reports. Party sources told Reuters on Tuesday that the exact details of a package were still being worked out.

"She wants to be populist, without thinking of the consequences," said D.H. Pai Panandiker, the head of theRPG Foundation, a New Delhi-based think tank.

"She wants all the goodies, and she does not want to accept that everything has a price, that nothing comes for free."

The package could include a "credible economic recovery programme" to beef up West Bengal's manufacturing industry and infrastructure, Dipak Dasgupta, the principal economic adviser to the ministry of finance, told Reuters.

Freeing up heavily subsidised fuel prices is viewed as a badly needed measure to help tame India's fiscal deficit, which swelled to nearly 71 percent of its full-year target in the first half of the year.

Rattled by street protests and facing major state elections next year, Congress party chief Sonia Gandhi may feel the need to shore up the government's centre-left credentials.

US raises concern over India's 'business environment'
The US today said it has concerns over India's business environment, cautioning that the policies designed to protect the domestic industry would eventually harm them.

"We encourage India to address concerns that many have about its business environment. In particular, there is increasing concern about some recent action that seems to tilt the playing field," US Under Secretary for International Trade Francisco Sanchez said at a CII event here.

Giving an example of India's national solar mission which requires domestic sourcing of contents, Sanchez said, "my concern is that many of the policies designed to protect Indian industries will only hurt them in the end".

He said this type of policy decisions "seems to tilt the playing field here in India away from US businesses and other foreign firms".

Sanchez, who is leading a high-level US business delegation said, India's recent policy directions and proposals limit its markets to develop domestic manufacturing capacity.

The delegation comprises Azure Power, Serious Energy, A123 Systems, Amonix Inc, Picarro Inc andSopogy Inc.


"For example in clean technology, local content requirement (LCR) explicitly discriminates against the imports," he said.


Besides meeting the industry leaders, Sanchez is scheduled to meet senior government officials, including Commerce Secretary Rahul Khullar, during his visit.


The US trade official said, the LCR system denies Indian companies accessing quality solar products from outside the country.


"With the path India appears to be following, will force India to miss out innovative products. I believe, it could end up hindering growth and results in missed opportunities," he cautioned.

Is the Trinamool Congress' reaction to the recent hike in petrol prices about its 'tolerance' wearing thin or about fending off charges of complicity?
By threatening to pull out of the United Progressive Alliance government over the recent hike in petrol prices, the Trinamool Congress leadership is trying to wriggle out of a politically deleterious situation in which the Centre finds itself, as disaffection mounts over the spiralling prices of essential items.
Needless to say, the threat is being made from a position of strength, the Trinamool Congress being the second largest constituent of the UPA. If carried out, it could pull the rug from under the feet of the government.
Whether the threat will be carried out or not is, of course, another matter. But the Prime Minister is certainly in for some hard bargaining on his return from his overseas tour if the apple-cart is not to be upset. For, all such threats — by definition in political parlance — are, for all practical purposes, pressure tactics.
Under attack in recent times from both the Left parties and, albeit with less stridency, the Bharatiya Janata Party, for not speaking out against economic polices of the scam-tainted Congress-led government at the Centre, the Trinamool Congress has found in the fourth hike in petrol prices this year an opportunity to express its resentment over not being consulted by the Congress in matters of major consequence, despite being a constituent of the UPA.
And in one fell swoop, it would also invalidate claims by her political rivals that she, by being a silent spectator in the government, is apathetic to the problems of the common man buffeted by the rise in the prices of essential commodities.
That the Trinamool Congress is peeved over the Congress riding roughshod over it was made clear in the reminder by its chairperson and West Bengal Chief Minister Mamata Banerjee that while a pullout by the party would result in the toppling of the government at the Centre, it enjoyed a majority on its own and was not dependant on the Congress to stay in power in West Bengal.
Doubtless, the Congress in West Bengal plays second fiddle to the Trinamool — a political liaison that has rarely been harmonious but has survived because of the Congress in New Delhi insisting that it has. One can already see some more disgruntled sections of the Congress in the State secretly delighting in Ms. Banerjee's most recent posturing.
"Somebody has to bell the cat. If we are outside the government, we can at least speak in the interests of the people," Ms. Banerjee has remarked. But it would be politically naïve to assume that the rise in the prices of petroleum products, the growing rate of food inflation and the consequent burden on the common man are the only reasons for her grouse.
Ever since assuming power in May, she has been expressing her displeasure over the Centre for failing to provide her government with a special financial package that would bail the State economy out of the bankruptcy it has allegedly inherited. The issue dominates her rhetoric. Is the pullout threat also a pressure tactic for extracting from the Centre the financial assistance?
By her own admission, the government of which her party is a part, has been responsible for the rise in prices of petroleum products "eleven times in twelve months" which she feels is "intolerable." This begs the question why the Trinamool Congress was not as assertive of its opposition to the price hikes then, the way it is now. If one goes by what Ms. Banerjee has to say, it is the party's "tolerance" which is now wearing thin.
Or is it that the Trinamool Congress is finding it difficult to fend off charges of complicity each time there has been a rise in prices and of pursing an economic line that is no different from that of the Congress? For that has been the argument of the Communist Party of India (Marxist), its principal adversary in West Bengal.
At least the threat of a pullout from the government and all the hype it generates could be designed to project the impression that the party is not just sympathetic to the common man's concerns but that its position in the government should be taken more seriously by the Congress.
After all, over the past two-and-a-half years "we have not even been given a room [for the party] in Parliament," not to talk of "we not willing to accept the burden [price rise] being thrust on the people," according to Ms. Banerjee.

And even before one can doubt the seriousness of intent, she pre-empts any questions that could be asked in reference to it. The Trinamool Congress is not "blackmailing or bargaining" as might be made out by some, Ms. Banerjee, who has always had a penchant for histrionics, has said. "Forgive us, but we have not done any wrong," she says, her hands folded.

Mamata Banerjee hold road show at Bhowanipore as part September 25 by-elections campaign

KOLKATA: West Bengal chief minister Mamata Banerjee on Saturday held a road show at Bhowanipore here as part of her campaign for the September 25 by-elections. Mamata is contesting the seat against Nandini Mukherjee of the CPIM, who by profession is a professor of computer science and engineering departnemt of the Jadavpur University.

This is Mamata's first contest for an Assembly seat in West Bengal. Mamata will have to a member of the state legislature by November 19 this year to continue as the chief minister. To help her winning the Bhowanipore seat, the state PWD minister Subrata Bakshi, who had won the seat in May this year, had resigned.

The results of the Bhowanipore by-election will be out on September 28. Even though Mukherjee of the CPIM had launched her campaign about 13 days ago, Mamata held her first road show on Saturday and sources in her party said she might not go for second round of campaign in Bhowanipore.

Bhowanipore is a Trinamool Congress bastion. Bakshi had won the seat in May assembly polls by a margin of about 50,000 votes. Neither Mamata nor the CPIM is sure about the fact that the chief minister will win the seat by a handsome margin. Bhowanipore will be chief minister's constituency. Only issue is the victory margin.

Bakshi had won the seat by about 50,000 votes by defeating Narayan Prasad Jain of the CPIM. There is no doubt that Mamata will increase the margin. Interestingly, Jain, who had contested the seat on a CPIM ticket, has recently joined Trinamool Congress and campaigning for Mamata.

Buddhadeb Bhattacharjee is supposed to address a Left Front gathering in the city on September 21. CPIM sources said that the party leadership was likely to organise a road show in Bhowanipore with Bhattacharjee on that day.

Mamata, will be busy on September 21 as Union home minister P.Chidambaram will be in the city to lay the foundation stone for a NSG hub near the city airport. Mamata will also attend the function and has got a green signal from the Election Commission for the purpose. Naturally, it may not be possible for Mamata to hold any election rally at Bhowanipore in September 21. The CPIM, it is learnt to grab the opportunity of Mamata's business on that day to give a finishing touch to their campaign at Bhowanipore.

Black money: India starts getting banking information from Switzerland

The Finance Ministry today said it has started receiving banking and tax-related information from Switzerland following revision of a tax treaty, a development that will help India in combating the black money menace and bring back funds stashed abroad.

"We are getting information from Switzerland...they will also provide information regarding tax-evasion cases," a senior Finance Ministry official said.

India and Switzerland had signed a protocol in August last year seeking to revise the Double Tax Avoidance Agreement (DTAA).

The European nation, the official said, has communicated to India that all legal requirements and procedures for giving affect to the protocol had been completed.

Geneva has also communicated to New Delhi, "The protocol comes into affect from October 7, 2011 and now it would be possible for India to obtain banking information in special cases from Switzerland commencing from April 1, 2011".

On a query whether Swiss authorities would provide more information on 700 bank accounts allegedly held by Indians in HSBC Bank, Geneva, Swiss Ambassador to India Philippe had said yesterday that his Government would respond to all legitimate requests by India.

As per the treaty, both the governments are entitled to release data in cases which has been defined in the treaty, the Ambassador had said.

Currently, the Indian government is looking into looking into details of Swiss bank accounts provided by French authorities.

As per a Swiss National Bank data, Indians held Rs 9,295 crore in 2010 in banks of Switzerland.

Government plans special MNREGA courts to check corruption
Concerned over embezzlement of funds meant for MNREGA, the Centre is planning to set up special courts across the country to expedite cases related to irregularities in the rural employment scheme.

Rural Development Minister Jairam Ramesh today said the Centre would consult with the Supreme Court about setting up special MNREGA courts to punish those found guilty of misusing funds meant for the rural poor.

The move comes in the backdrop of reports that the UPA Government's ambitious rural job guarantee scheme is marred by corruption. Recently, Ramesh had written a hard-hitting letter to Uttar Pradesh Chief Minister Mayawati asking her to recommend a CBIprobe against state officials for their alleged role into embezzlement of MNREGA funds.

The concept of MNREGA courts has already been put into use by Andhra Pradesh where they would function from January next year, the Minister said.

"Andhra Pradesh has passed an ordinance in August this year for setting up special courts in order to ensure that officials against whom action is taking as a result of social audit do not use the judiciary to delay the process," he said.

"I think it is a good initiative and it is worthwhile adopting this system in other states. We will consult the Supreme Court in the matter as well," Ramesh told reporters on the sidelines of a workshop on social audit in MGNREGA with state governments here.

According to the Andhra Pradesh Social Audit (Punishment of Corrupt Practices) Ordinance 2011, the corrupt persons and those indulging in irregularities would be noticed during the social audit of NREGS and the proposed law provides for arresting the accused.

The ordinance proposes to set up mobile courts to try the cases of corruption and punish the guilty at the earliest.
