Your initiative is urgently needed to stop the bill that masquerades as "Food Safety" legislation.  Call your US Senators today (contact info below).  On November 30, the US Senate passed S. 510, the Food Safety Modernization Act.  It arrived at the House of Representatives containing revenue raising language that made it unconstitutional (because that language has to come from the House).  The House circumvented this legality and inserted the S. 510 text into HR 3082, possibly via HR 1755 on December 8, 2010.  In any case, the bill goes back to the Senate.  It will probably be part of this omnibus package and may carry the number HR 3082.  Regardless, this bill needs to be stopped because of the deleterious effect it will have on food safety, economics, farmers, and consumer choices.  It costs 1.4 billion dollars and expands FDA and government bureaucracy to unnecessary extremes.  Remember, this is an FDA that thumbs its nose at safety while protecting industry.  In 1996, at least 106,000 Americans died from properly prescribed "FDA approved" pharmaceuticals (this is the official statistic reported in JAMA in 2000).  With increased pharmaceutical advertising, one can only imagine how many people die today, falsely believing that the FDA is somehow holding a safety net.  How can we trust the FDA with ambiguous authority over our food when they cannot handle basic responsibilities?

Back to the Food Safety bill -  this bill essentially kills the competition, by creating enormous expenses for small and organic farmers.  Language was inserted (Tester-Hagan) to support small farmers making less than $500,000 gross sales.  This is a ridiculously small figure.  If you had a small farm with a few employees, you would be hard-pressed to make it on $500,000 after purchasing equipment and farm supplies.  This bill weeds out the competition and favors the large industrial farms where most problems originate.  Your accessibility to high quality local produce will be threatened if this bill becomes law.  Is it any coincidence that the Food Safety czar, Michael Taylor, used to work for a law firm hired by Monsanto?  Is it any coincidence that George Soros' second highest holdings are reported to be with Monsanto?  This is not a partisan issue, although you may be led to believe it is by the polarization in Congress.  This level of manipulation has been going on for years, through many administrations, and is not limited to current politics.  If you really care about health, one of the greatest gifts you can give yourself and your family is high quality food grown locally and authentically.  For those who feel concerned about increasing food safety, there are alternative proposals (e.g. by Senator Coburn) that address these issues without placing a burden on farmers or taxpayers.

Call your Senators TODAY!  Tell them to Vote NO on the Food Safety language contained in HR 3082 (or the Omnibus package), and/or that was earlier contained in Senate Bill 510.  Do NOT push this through a lame duck congress.  At the very least, allow the food safety issues to be reviewed by a newly elected congress in which the public has placed more confidence.

Dear Citizen for Health,

For those of you who haven't already heard, the House lame-duck leadership amended the Continuing Resolution Funding Bill - intended to keep the federal government running for another year - to include the language from S. 510, the FDA Food Safety Modernization Act. Unfortunately the House rushed to action last Wednesday and passed it, sending it along to the Senate. Senators plan to take up the Continuing Resolution once they've dispensed with legislation extending tax cuts, so further action could happen as soon as today, Monday, December 13th.

It is quite unusual to attach such an initiative to a bill authorizing continued government funding and operations.

Urge your Senators NOW to resist any effort to ram through S. 510!

And so, back to the Senate we go. Make no mistake - your efforts are having an impact, and we can't give up now! The House vote was very close: 212 to 205. This is a reflection of how your thousands of messages have helped a significant number of legislators stand firm in the face of pressure from big Agribusiness.

We have to keep holding their feet to the fire and stop this dangerous policy from becoming law. The Senate can still strip S. 510 from the Continuing Resolution before passing it. Congress needs to recognize that:

--Combining a controversial regulatory bill with the Continuing Resolution to fund government operations is inappropriate at best, and at worst, shameful.

--It is even more disturbing that this has been done in spite of thousands and thousands of voters who have made it clear they believe that the federal government is too big and must stop over-regulating.

--S. 510 must be stripped from the Continuing Resolution so that Congress can decide to continue funding at a certain level without muddying the process with extraneous matters.

--We will be monitoring the Senate and expect them to act from principle and not the language from S. 510.

Tell your Senators NOW to strip S. 510 from the Continuing Resolution!
