The undersigned demand that the plan to link MGNREGA to aadhaar (or UID) be

revoked immediately. This is an extremely dangerous move that threatens to

cause havoc in MGNREGA's fragile structure.


The Ministry of Rural Development has put out a tender (dated 11 October,

2010) worth Rs. 2162 crores to engage "service providers" for MGNREGA under

a "public private partnership" model. The contract includes "UIDAI compliant

enrolment of job card holders under MGNREGA scheme", "Recording...data in

the field such as biometric attendance at worksite with GPS coordinates..and

updation of centralized MIS." and similar measures.


Clearly, the Ministry intends to link the issue of new job cards to UID

enrolment in the states. Job cards issued in 2006 are due to expire in 2011.

Job cards are required to claim employment under the MGNREGA. If the issue

of new job cards is linked to UID enrolment, there is a danger of creating a

jam that would disrupt the programme. The process of job cards renewal, in

any case a slow process, will be further slowed down. Many people are likely

to be denied their entitlement to 100 days of work as they will be without a

job card. Further, in spite of the hiring of "service providers", the

entire administrative machinery is likely to be diverted into capturing of

biometrics or supervising "service providers". The scale of MGNREGA works is

bound to suffer. This would be a gross injustice to NREGA workers, who are

already deprived of their basic entitlements.


The proposal of "biometric attendance at the worksite with GPS coordinates"

is completely impractical - many MGNREGA worksites are in remote areas with

poor or no connectivity. Does that mean those worksites will close down?


We do welcome the use of technology provided that it enhances transparency,

empowers labourers and is cost effective. Such technology has been used with

success in Tamil Nadu. For instance, it combines SMS reports on daily

attendance with random spot checks to curb the problem of fake muster roll

entries. Localized use of biometrics, independent of UID, to speed up

payments can be considered. Biometrics and UID are not the same. In

Rajasthan, simpler measures have been put in place, such as "transparency

walls" where all job card holders in the Gram Panchayat are listed along

with days of work, allowing people to monitor implementation.


There are many problems in the implementation of the MGNREGA which need the

urgent attention of the Ministry. These include the non-payment of minimum

wages, delays in wage payments, insufficient scale of MGNREGA works,

discrimination against Dalits and women, and so on.


We therefore demand that neither MGNREGA employment nor wage payments be

linked to UID enrolment. Employment of 100 days under MGNREGA is the only

universal entitlement that the rural poor enjoy. It should not be

jeopardized by the introduction of disruptive technology under pressure from

corporate and security lobbies.

I am satisfied to have visited Tamilnadu without which I would not have rediscovered my lost Non Aryan Indigenous Aboriginal Identity. It was a tight schedule.     The senior Congress leader and Finance Minister Pranab Mukherjee on Sunday, Nov 28 met Opposition leader Sushma Swaraj and senior Bharatiya Janatha Party (BJP) leader LK Advani appealing to allow the house to function.

    But, Opposition leaders remained firm with the demand of Joint Parliamentary Committee (JPC) probe to the 2G spectrum scam.

    Pranab has offered to discuss the issue in the Parliament and even a Central Bureau Investigation (CBI) probe but the opposition has rejected his offers.

    The demand of the JPC probe by Opposition parties has deadlocked the Parliament functioning for the last 12 days.

    Mirwaiz Umar Farooq left egg-faced in Kolkata

    Akhil Bhartiya Vidyarthi Parishad (ABVP) workers on Sunday staged protests against All Party Hurriyat Conference chairman Mirwaiz Umar Farooq's visit to Kolkata.
    Mirwaiz, was coming out of an auditorium after attending a seminar on 'Kashmir- A Way Out' organised by the Centre for Peace and Progress.BVP members shouted slogans, displayed banners and hurled eggs at Mirwaiz's vehicle prompting police to arrest 25 of them.
    The banners read 'Bharat Ek Hai' and 'Mirwaiz Murdabad'.
    The Hurriyat leader was whisked away by security personnel as he moved out from the building after the seminar.
    On Thursday, the Mirwaiz was beaten up by activists of the Bajrang Dal, the Vishwa Hindu Parishad, Rashtriya Swayamsevak Sangh and Kashmiri Pandits for his anti-Indian comments.
    Speaking at a human rights seminar in Chandigarh, the Mirwaiz had declaimed some pro-freedom slogans which provoked the audience.

    In a major blow to the ambitious Lavasa lake city project near Pune, the Union environment ministry headed by Jairam Ramesh has termed all construction activities in the 25,000-hectare project illegal.

    A show cause notice from the ministry deems all structures so far unauthorised as they have been built without any environment clearance under its notifications of 2004 and 2006.

    The notice requires that the "status quo ante for construction and development as on date should be maintained" pending decision on the notice. It simply means that no further construction can be undertaken.

    The Lavasa Corporation, a group company of Hindustan Construction Corporation (HCC), has also been asked why the unauthorised structures should not be demolished "in entirety". It means that all big bungalows, villas and farm houses may face action now.

    Ramesh told DNA that he had given 15 days to the state government and the promoters to respond, and halt all activity until a decision was taken in the matter.

    Many influential politicians, bureaucrats and others have villas and plots in the Lavasa lake city. No action has yet been taken. Former revenue minister Narayan Rane had gone on record a few weeks ago saying that it was too late in the day to initiate any move since it had already come up.

    He has suggested that the state should impose only compounding fee on the developers.

    Of late, there has been a flood of petitions to prime minister Manmohan Singh and UPA chairperson Sonia Gandhi complaining about how the entire forest land had been encroached upon, acquired and developed in violation of rules. Ramesh decided to act swiftly as the Maharashtra government had been dragging its feet.

    The ministry's notice has put the fate of the real estate firm's proposed Rs2000-crore IPO in jeopardy. It was recently cleared by the Sebi. The notice came at a time when Lavasa Corporation is already in the thick of a bribery scam, and its offices have been raided by CBI.

    A spokesperson of the Lavasa corporation said, "We are still to receive the notice. As and when such a notice is received we will respond after studying it."

    When asked why the firm figures on the list of recipients of loans from banks which have been under the CBI scanner in the loans kickback scam recently, and there's a fear in the market that banks may review all the loans given to several companies, Ajit Gulabchand, chairman of HCC & Lavasa, defended the project.

    "Lavasa is a project of great importance to the Maharashtra government's policy of building a hill station. In this context, we had to raise money with the banks and all transactions have been very clear and syndicated without any special favours or anything at all."

    The show cause notice asks the developers to provide the status of the project "with photographs/satellite maps indicating the constructions as on 18.3.2004, 7.7.2004, 14.9.2006 and up to date". It says that the developers had built over 1,000 metres above sea level on 47.3 hectares of land without obtaining prior clearance.

    Buddhadeb admits CPM leaders committed mistakes

    A section of partymen and leaders through their arrogance and anti-people moves had alienated people in some areas in the state, Bhattacharjee said.
       
    "We have to bow our heads and go to the people who have not taken such behaviour lightly," the CPI-M leader said at a public meeting in North 24-Parganas district organised by the Left Front.
       
    "We have asked such partymen to leave," he said.

    While claiming that the CPM was committed to industrialisation, Bhattacharjee noted that the party had lost in this industrial township during the last Lok Sabha polls and appealed to the youth who have left the party to return to the fold.
       
    CPM candidate Tarit Topdar had lost the 2009 Lok Sabha elections from Barrackpore, a seat which he held since 1989, to Trinamool Congress' Dinesh Trivedi.
       
    Gunning for both Congress and Trinamool Congress, Bhattacharjee said that while the Congress was to be blamed for all the state's past ills, the latter was a party of irresponsible people bent on taking the state on the path of anarchy.
       
    "They are talking about 'paribartan' (change). The only change that they can bring about is taking the state backwards instead of on the path of development," Bhattacharjee said.
       
    The chief minister said Trinamool Congress' suicidal politics was forcing industries to leave the state.
       
    He claimed the economy of Singur would have changed for the better if the Tata Nano plant had been set up there and allowed people to earn more than whatever they had been earning from doing agriculture.
       
    Taking a jibe at Mamata Banerjee, Bhattacharjee said, "There are 84 engineering colleges in the state, where will the passouts go? Just chanting 'ma, mati, manush' won't do."
       
    Taking a dig on the Railway Minister laying foundation stones of several rail projects in the state, the chief minister said, "This is not so easy. There is a difference between promising thousands of jobs and actually giving those."

    Aadhar provides national portability: Nandan Nilekani

    NEW DELHI: 157,136—the number of UIDs already issued. With this, a portable identity is on the anvil for Indians that is expected to address the problem of migration. Now, 120 million migrants in the country can carry their identiy with them and can be authenticated wherever they are.

    For Nandan Nilekani , the chairman of Unique Identification Authority of India , the challenge now is not just to roll out one lakh or more Aadhaar numbers a day, but to create an ecosystem for players to build applications on top of this identity infrastructure. Now, Nilekani has been negotiating with the Reserve Bank of India to allow banks to treat Aadhaar number as the only document for opening an account. In a free-wheeling interview with Shantanu Nandan Sharma, Nilekani talks about life after Aadhaar when a villager would be able to use a micro-ATM in his locality, or a migrant from Bihar would be able to flash out his number in Mumbai as an identity proof. Excerpts:

    You will issue only a number and not a card. That means even after I get my UID number, I will have to carry separate ID proofs?

    Whether it's a passport, a ration card or a PAN card—each one of these has a purpose. Whether they will continue to remain as it is, or merge in the future, it's a matter of future direction . Fundamentally, what we are giving is an identity infrastructure.

    What does the number mean for a citizen?

    Broadly, Aadhaar, as it is called, addresses several things. It addresses the issue of inclusion. It's most important because we have hundreds of millions of Indians who don't have an acknowledged existence by states. And if you don't have acknowledged existence, you can't avail of many public and other services. You can't rent a house, you can't get a job. In a way, identity is the foundation for life in some sense. First, it gives a chance to a large part of people who are not in the banking system to be a part of the system.

    Second, it addresses the problem of migration. India is already a migrant country. We have 120 million migrant population. And the migration is going to go up in the next 20 years. We can give them a portable identity which they can carry with them and authenticate wherever they are.

    What does a migrant do now?

    Either he has no identity or even if he has one, say a ration card, the moment he moves out of his area, it does not have any validity. The ration card is a state document, not a national document. What Aadhaar does is that you get a number in one part of the country, and it is valid in all parts of the country. It gives you national portability. Ours is a nationally verifiable identity infrastructure. So it makes identity portable like a mobile phone makes communication portable.

    Also, it provides a platform for innovation. The way we have made this architecture, it allows new innovators to build new services on the top of it. Therefore, it can be a platform for delivery.

    What's the road map ahead?

    We launched it on September 29, now we have already crossed 100,000 in seven states so far. We are sending the users a letter, and that itself sometime will be a proof of their identity. And we are providing online authentication all over India.

    Recently Visa has announced that they will build a card around UID. What does it mean?

    Aadhaar provides an identity infrastructure. If somebody is in the financial services—be it Visa, MasterCard , NPCI (National Payments Corporation of India) or even the banks—they can develop a variety of financial products which use Aadhaar authentication as one of the identity proofs. We are providing an open architecture which allows people to build applications on top of it.

    Do you see more number of players to come and do business around Aadhaar?

    We have agreements with Reserve Bank of India, Indian Banking Association, NPCI, all the banks—all of them are looking at using Aadhaar for financial inclusion.

    Will the Aadhaar number be enough as a proof to open a bank account? Will the RBI agree?

    One of the major problems for the poor to get a bank account is the lack of identity. And because of security reasons, the KYC (know your customer ) requirement has become more and more demanding. The poor is out of this system. We are negotiating with regulators and the finance ministry to allow 'Aadhaar equal to KYC' for bank accounts . And if that happens, once you have an Aadhaar number, you don't need any KYC to open a bank account. This will include many marginalised people into the banking system.

    According to the new Bill being introduced in Parliament, you want to change the name UID.

    No. Changing the name is just one thing. It's now National Identification Authority of India. It gives this organisation more stature. The Bill is brought in because we need to have regulation on enrolment and authentication and penalty of misuse, etc. All that requires regulatory architecture.

    There is an apprehension particularly in North-East that Aadhaar will give an illegal migrant an advantage to get Indian citizenship?

    This is in no way, a citizenship or nationality number. The authorities who provide nationality document will continue to do the same checks.

    You have crossed issuing 1 lakh numbers so far? What are the milestones next?

    First, we have to stabilise our platform. Since we have rolled out, many small issues have come up which we need to sort. That's what we are going to do in the next six months. Second, we have to increase the enrolment—from 10,000 a day to 100,000 a day, then we have to scale it up further. That's a big challenge. Also, we have to launch applications on this infrastructure.

    What kind of applications?

    For the banking system, once 'Aadhaar equal to KYC' is agreed upon, then we will not only make opening a bank account for poor easier, but it will help creating a network of mini ATMs. So, instead of walking 40 kilometres to reach the nearest bank branch, a man in a village can walk into a micro-ATM .

    How will a micro-ATM work?

    It's a device, say a mobile phone with fingerprint reader attached to it. You go to a micro-ATM , put your finger, authenticate yourself and withdraw money from your bank account. The micro-ATM will be inside the house of a business correpondent of a bank who will then give money say from a kirana store, and it will be linked to his account . Now, we are doing a pilot project on it.

    Any other applications?

    We are working how 'Aadhaar equal to KYC' may give you a mobile connection. We are discussing it with DoT (department of telecommunications). On the top of these, the government gives a lot of cash benefits like old-age pension, disability pension, widows pension, NREGA payment—all these can flow into the banking system.

    What does UID mean for corporate India?

    It has many possibilities. The employability can become simpler. Also, people's benefits can be made more portable. Once the provident fund schemes begin to use it, the benefits become more portable.

    Has life changed after joining the Govt?

    The life is quite different. I moved from Bangalore to Delhi, moved from private sector to government , moved from running a hundred thousand person company to launch a startup. But overall, I am very happy with what I have done in the last 16 months. It has been a positive experience. It has a few challenges but every job has challenges.

    You have recruited a number of bureaucrats as your main deputies?

    We have a good mix of people. We have some excellent people from within the government and some from outside, volunteers, private sector people, interns etc. It gives us a diverse intellectual capital which is useful for the project.

    But will you return to the corporate sector?

    Governance requires a lot of technology-enabled reforms. I think I can help in that area.

    Will more corporate people join the Govt?

    I don't want to speculate but if the government wants to bring in more people from outside, we will then have access to a wider talent pool.

    What's after UID?

    It's a big job. I have enough work for four years.

    Jairam Ramesh rubbishes charge of being anti-Maharashtra

    Union minister for environment and forests Jairam Ramesh today rubbished criticism about him being anti-Maharashtra and against development.

    Talking to reporters after giving a green signal to the Jaitapur nuclear power plant, Ramesh said he supported sustainable development.

    The minister said he had given the environmental clearance to the Jaitapur plant in 80 days from the day NPCIL submitted the final environment assessment report to his ministry.

    "The Navi Mumbai airport clearance took 115 days from the time CIDCO submitted its assessment report. We had to do some hard negotiations with CIDCO. As per laws, my ministry has to clear any environmental clearance proposal in 105 days," he said.

    According to the minister, 95% of the projects which come to his ministry get environmental clearance while 85% get forest clearance.

    "Forest clearance takes time because we have to tread with lot of caution," he said.

    Ramesh said Jaitapur plant falls in Konkan region where the districts of Raigad, Ratnagiri, Sindhudurg situated in the western ghats are ecologically sensitive.

    "The only forest cover in Maharashtra is in this region and then in the eastern Vidarbha belt. We have to strike a balance when power projects have to be sanctioned here," he added.

    Ramesh described the green signal to Jaitapur as a historic day. "Forty years ago, the first nuclear power plant on commercial scale was started in Tarapore in Maharashtra. This will be a significant step forward in the giant leap in nuclear power programme," he added.

    Talking to reporters in Mumbai, Ramesh said a show cause notice has been issued to the company. "When they reply comes, we will follow procedures as per law," he added.

    Ramesh said the show cause notice was sent because in the view of his ministry, existing laws of forest conservation and environment protection had been violated.

    "No decision will be taken arbitrarily. Lavasa will be given a chance to put forth their point. Action would be taken after due consideration," Ramesh said.

    He said the priority of his ministry was to monitor implementation of environment laws passed by Parliament.

    When asked about the Adarsh Housing society, Ramesh said the lawyers have replied to the show cause notice.

    Chief minister Prithviraj Chavan said an FIR has been filed into the key missing papers related to the Adarsh society from the Urban development ministry.

    "Investigations are on and action would be taken against the guilty," he added.

    Chavan also informed that an internal inquiry into the issue is also in progress.

    Ratan Tata to move Supreme Court on Radia tapes

    New Delhi: Critical of the "unauthorised" release of tapes of his conversation with PR consultant Niira Radia, the $73 billion-Tata group chief Ratan Tata may move the Supreme Court on Monday to seek action against those behind the leakage.
    Tata may invoke Article 32 of the Constitution, claiming that his Right to Life, which includes right to privacy, has been breached by the leakage of these tapes.

    Under Article 32, any person who feels that his fundamental rights are violated can straightaway move the highest court of the country seeking redressal of the grievance.
    The petition, where Union of India is sought to be made a respondent, seeks that responsibilities be fixed on who leaked the tapes -- recorded by the Income Tax authorities in 2008 and 2009 -- that were meant for investigation.
    Asked about the petition and its details, a Tata group spokesperson declined to comment.
    Some of the conversations between Tata and Radia, whose PR firms have been engaged by the group, relate to personal details that could no way be part of investigation, Tata is expected to argue in the petition.
    In the wake of 2G spectrum allocation scam allegedly involving Rs 1.76 lakh crore, some magazines published taped conversations Niira had with politicians, journalists and industrialists.
    Some of these tapes have also come up on various websites, stirring a major controversy over the alleged nexus between the lobbyists and journalists.
    In an interview to NDTV on Thursday last, Tata had said that the agencies had been given a special right to be able to invade people's privacy for national security or for enforcement of law.
    "So they can do so. That additional power is a very special power which has to be exercised with a sense of responsibility. The content needs to be held for prosecution purpose and not be misused, and certainly to go out to have a field day with.
    "There doesn't seem to be prosecution on the one end and there doesn't seem to be confidentiality on the other," he said.
    "I have listened to some of the tapes and you know I am not a Delhi resident... but I wonder to the great extent if other people's phones were tapped whether we would get similar kinds of conversation. I do not know if she has the power to influence the Cabinet appointments or anything of this nature," Tata said.
    Asked about who could be behind these, Tata said: "It could be enemies in the government, corporate rivals, I couldn't say. It is not a natural thing."
    He was responding to a question whether corporate rivals were behind the attack on Radia-led Vaishnavi Corporate Communications which represents Tata Group firms.
    Explaining how the group decided to hire an external agency to represent it, Tata cited the allegations that the group was "hobnobbing with the extremists in Assam" and said, "every time we had tried to do anything it was a defensive move, rebutting or denying or usually we got relegated to a back-page of newspapers.
    "So we decided that why do we not go out and seek a firm to represent us and that's how we, in fact, came together with Niira Radia who formed this company."
    Tata also asserted his group has never overturned the government policy or used Radia to make payments or to seek favours.
    "We have advocated level-playing fields. We have advocated changes in policy through her or directly. But never once have we done something to exploit a political or a policy issue. Never once have we used her to make payments or to seek favours and we have had a good professional relationship with her," he said.
    On Niira's conflict of interest in view of her other corporate clients, Tata said that going forward she would have to take call on business relations with his group because of her handling the accounts of Mukesh Ambani-led Reliance Industries.
    "Today, with the two sides (Ambani brothers) coming together I think there are more of a chance with conflict. Today, Niira would eventually have to make up her mind what she wants to do."

    Obama's support kicks of hectic efforts for India's UNSC bid

    New Delhi: US President Barack Obama's expression of support has lent an impetus to India's efforts to secure a permanent seat in UN Security Council, with hectic discussions having been initiated with a number of countries like France, Japan, Russia and Germany.
    A push to India's bid for permanent seat is also being given at the United Nations Headquarters by the country's Permanent Mission.
    Close on the heels of Obama's announcement, France's Head of UN Division in the Foreign Ministry Sylvie Berman visited Delhi recently and met Foreign Secretary Nirupama Rao and some other senior officials of the External Affairs Ministry to discuss the issue of reforms, sources said.
    This was followed by a visit by Japanese Deputy Vice Foreign Minister. The Head of Russian Foreign Ministry's UN Division and German officials are expected here soon.
    "An impetus to the efforts to secure permanent seat has been lent by Obama's announcement. It has given a boost," a source noted in the context of hectic parleys.
    The focus of the discussions is overall reform of the UN, including that of the Security Council, in permanent and non-permanent categories, the sources said.
    India is set to assume the non-permanent membership of the Security Council in January for two years and this aspect also came up for discussion in terms of the issues that the powerful world body is going to be faced with.
    The immediate global issues, on which India will have to take position as non-permanent member of the UNSC, relate to referendum in Sudan expected in January, the UN report on the assassination of former Lebanese Prime Minister Rafiq Hariri and Nepal where the political system is deadlocked.
    Notwithstanding Obama's announcement of support, India is keen to strive for the permanent seat under the format of G-4 which also includes Brazil, Germany and Japan.
    Significantly, three members of the G-4 -- India, Brazil and Germany -- will together be in the UNSC from next January as non-permanent members, providing them an opportunity to push their agenda further.
    For the UN reforms, five rounds of inter-governmental negotiations have taken place since 2009 and made some progress.
    The negotiations are taking place on five key aspects - categories of membership, question of veto, regional representation, size of enlarged Security Council, and working methods of the council and its relationship with 192-member assembly.
    The G-4 has been pushing for inclusion of six new permanent members -- two each from Asia and Africa and one each from Europe and Latin America -- and four non-permanent members to raise the strength of the Security Council from 15 members to 25.
